INFORMATION FOR EXISTING TENANTS AND NEW TENANTS UNDER THE MANAGEMENT OF FLYNN LETTINGS

This page provides you with information about becoming a tenant or if you are a tenant of Flynn Lettings this is where you will find the latest information about your tenancy.

 

Rent


Payable monthly in advance either by standing order, instant transfer or cash.

 

Security Deposit

An amount set by the Landlord (usually FIVE WEEKS rent) and payable before you move into the property.

 

Your deposit will be returned on termination of the tenancy agreement, subject to any deductions e.g. breakages, rent arrears.

Please note no interest is paid on deposits.

 

Tenants deposits will either be registered with My Deposits or DPS depending on your landlords preferred scheme. Further details can be found out about both schemes below

 

In addition to paying rent for the property, you may also be required to make the following permitted payments, inclusive of VAT (where applicable):

 

Holding Deposit (per Tenancy): One weeks rent

 

Security Deposit (per tenancy): Five weeks rent. 

 

Lost Key(s) or Other Security Device(s): Tenants are liable to the actual cost of replacing any lost key(s) or security device(s). If the loss results in locks needing to be replaced, the cost of a locksmith including new locks and replacement keys for the tenant, landlord and any other parties will be charged to the tenant. If extra costs are incurred there will be a charge of £15 per hour.

 

Unpaid Rent: Interest at 3% above the Bank of England Base Rate will be charged from the Rent Due Date until paid. This will not be charged until the rent is more than 14 days in arrears. Costs incurred obtaining rent will be a charged at a rate of £30.00

 

Council Tax, Utilities and Other Services: Tenant(s) are responsible for paying bills in accordance with the tenancy agreement, which could include (but are not limited to) council tax, utility suppliers (gas, electricity, water) and other services such as broadband, TV License, Satellite and telephone services.

 

At the request of a tenant;

 

Early Termination: Should the tenant(s) wish to end their tenancy early, and the landlord agrees, all tenants will be liable to cover the landlords’ costs in re-letting the property, as well as all rent due until the tenancy end date or until the start date of a replacement tenancy.

 

Amending a tenancy agreement: £50 per agreed change. To cover the costs associated with taking landlords instructions, carrying out new tenant referencing, Right-to-Rent checks, deposit registration as well as the preparation of new tenancy agreements.

 

Additional Rent for Pet(s)/Permission for a pet: If the landlord agrees to pet(s) at the property, additional rent of £20 per calendar month per pet will be payable. This will be agreed with all parties in advance prior to paying the holding deposit. Our standard pet policy will be enforce from the date of your tenancy agreement. 

Should you already be in tenancy and request permission for a pet then our standard pet policy will come into force from the date permission is granted.

If you are found to have a pet living in the property without prior permission being sought then our standard pet policy will be enforce from the date of your tenancy agreement and not from the date that you are found to be in breach of your tenancy.

Flynn Lettings Application Process


When viewing a property you will be asked if you would like an application form sent to you. This application form is sent to you via a referencing company called Rent4sure.

The application form is intended to capture your static information such as your residential status and income information. Receiving an application and completing the form does not mean that you have secured the property. All applications will be sent to our landlord to make an inform decision on if they would like to grant you a tenancy. Flynn Lettings can only advice our landlords and ultimately does not make the decision on who the landlord wishes to grant a tenancy to. 

Flynn Lettings will endeavour to contact you within 48 hours to let you know if you have been pre-approved and invited to pay the holding deposit to secure the property.

 

There are two ways to process your application.

 

1 – Full Referencing Service, carried out by Rent4Sure.  

 

2 - Self Referencing Service, carried out by yourself.

If you are not able to provide any of the above documents please raise this with us before paying the holding deposit

 

We will send you  our standard terms and conditions to agree when your application has been pre-approved by our landlord. This will include all information including the rent and deposit agreed plus a tenancy start date. 

 

If after paying the holding deposit, and before signing a tenancy agreement you withdraw your application for whatever reason, reasonable costs will be deducted which are as follows;

  • The cost of marketing a property to each landlord is £150 + VAT which is payable each time a property is marketed. 
  • Referencing charges incurred by Rent4sure
  • Your landlord may also deduct loss of rent 

If your application is declined by Rent4sure e.g. credit check failure or income reference does not meet the 2.5x annual rent threshold the above reasonable costs will be deducted.

 

If you fail to enter into a tenancy agreement, including any guarantor agreement, by the above date, reasonable costs will be deducted, unless we have mutually agreed to move your tenancy commencement date. 

 

If the landlord decides not to proceed which is not due to your referencing and/or credit check your holding deposit will be refunded to you.

 

Once the holding deposit is paid we will send you a formal email confirming receipt. The email will contact all documents required by us to serve on your. 

 

Your applications will then be submitted to Rent4sure to carry out your credit checks and your referencing. Once we have received all your documents and Rent4sure approve your application we will email you to confirm and request a suitable time for you to come into our office to read and sign the tenancy agreement. All parties must be present at the time of signing the tenancy as well as having any further Identity Documents that we have asked you to bring with you.

Rental Period

Our normal first fixed term is six months unless agreed with the landlord prior to signing your tenancy agreement.

 

Guarantors

A guarantor may be required if we believe that your application is not strong enough, we will discuss this with you before you make an application so you are aware.

 

Insurance

A condition of our tenancy agreement requires you to have contents insurance to cover a minimum of £2500 for your liability to your Landlords belongings. Your landlord will have buildings insurance to cover the building. Please note that this does not cover any items that you are responsible for during your tenancy, which includes broken windows.

 

What is a Periodic Tenancy Agreement?

A periodic tenancy is a tenancy that runs for a certain period of time, most commonly month to month. Periodic tenancies can also run on a week to week or quarterly basis, although this is less common.

Unlike fixed term tenancies, periodic tenancies work as a rolling contract which can be terminated by landlord or tenant by giving notice.

 

How Does a Periodic Tenancy Work?


While a fixed term tenancy lasts for an agreed set of time, a periodic tenancy works on a rolling basis, from month to month. It doesn’t end until one party gives notice.

In a periodic tenancy, the period depends on when the rent is paid by the tenant. So, in a monthly periodic tenancy the tenant would pay rent each month.

 

Shorthold tenancies become periodic tenancies after the fixed term agreement expires and if there is no new contract drawn up with the remaining tenants. The assured shorthold tenancy will automatically become a periodic tenancy as long as the tenants do not change, and they are happy to retain the same contract. The same conditions will apply and there is no further action needed by the landlord or tenant.

 

Periodic Tenancy Notice: Tenants

To end a periodic tenancy, tenants will need to give the right amount of notice depending on the terms stated in the tenancy agreement. They also need to ensure it ends on the right day. For example, if a monthly periodic tenancy began on 1st January it will need to end on the last or the 1st day of the month. From this date, they will no longer be liable for rent payments.

 

Statutory Periodic Tenancy Notice

If it is a statutory periodic tenancy, tenants must give at least 1 months’ notice for a monthly contract or at least 4 weeks’ notice for a weekly contract. The notice must end on the first or last day of the tenancy period.

 

Standard Pet Policy 

 

1. Tenants are responsible for the health and welfare of their pets. In accordance with the Animal Welfare Act 2006 and the Animal Health and Welfare (Scotland) Act 2006, all tenants have a duty of care to provide their pets with a suitable place to live, a suitable diet, proper exercise and adequate health care.

 

2. If the landlord believes that a pet kept in their property has been neglected or abandoned, they will report the case to an appropriate animal welfare organisation.

 

3. Tenants must not leave their pets in the property when they are away unless clear arrangements have been made for their care. Pets should be boarded elsewhere but close supervision by a neighbour may be acceptable for some animals.

 

4. Dogs should not be left alone in the property for more than 3-4 hours at a time. Tenants must ensure that their dogs will not cause damage to the property if they are left unsupervised.

 

5. All pets must be vaccinated and regularly treated for fleas and worms (if appropriate). Tenants may be required to provide evidence of this from their veterinary surgeon.

 

6. Tenants must ensure that their pets do not cause a nuisance to neighbours or visitors. This includes excessive noise and damage to other people

 

7. Pets must not be allowed to foul inside the property, except for caged pets and pets trained to use a litter tray. Any pet faeces must be removed immediately from the garden or outside areas and disposed of safely and hygienically.

 

8. Tenants are responsible for keeping all areas of the property clean and free from parasites, such as fleas.

 

9. Dogs must by law wear a collar with their owner’s name and address on it when in a public place. Cats should also wear a collar

 

10. Dogs listed under the Dangerous Dogs Act 1991 and any animal listed in the schedule of the Dangerous Wild Animals Act 1976 may not be kept in this property.

 

11. Tenants may not breed or offer for sale any animal in any property.

 

12. The tenants agree that after vacating the property a full clean must be carried out including all carpets that must be professionally cleaned with anti-flea treatment in all rooms.

Right To Rent

Before you can rent a home in England, a landlord or letting agent must check your immigration status and that of anyone aged 18 or over who'll be living with you.

They'll ask to see your passport or other official documents that prove your immigration status. They must take copies of the documents and keep the copies safe. Current or expired passports are acceptable documents for British, Irish and EU citizens.
